East Hampshire District Council has a statutory duty to
remove any accumulations of waste/rubbish which have been left on the public
highway or public land under its control.
The council is not responsible for clearing waste dumped on private
property. In such cases the owner/occupier is responsible for removing
this.
The Clean Neighbourhoods & Environment Act 2005 gives councils many new
powers to ensure that the environment is defended against the negligent and
deliberate dumping of waste.
Wherever possible the council will prosecute individuals and companies that
are found to have fly tipped waste illegally in East Hampshire. The
Magistrate's Court has the power to fine offenders up to £50,000 and two years
in jail if found guilty.

Service Level and Timescale
The council has a target of removing smaller fly tips (i.e. less than 1
cubic metre in size) within 24 hours of being informed of their presence.
Larger flytips (i.e. larger than 1 cubic metre) will take longer, as they
need specialist lifting equipment to remove them. The council has a target of
removing large fly tips within 10 working days of being informed.
Additionally fly tips of vehicle tyres will also take longer as a specialist
contractor is required to arrange disposal. The target is being reviewed, but
is currently 5 days.
- Can you remove some rubbish that has been dumped in my garden?
Unfortunately East Hampshire District Council are unable to remove any items
which have been left on private land/property.
You would need to dispose of the rubbish yourself. The best option would be
to take the items to your nearest public amenity site.
Alternatively you can employ a registered waste disposal company to collect
and dispose of the rubbish.

Using a registered waste carrier/disposal company ensures that waste is
taken to a proper disposal site, where it can be treated appropriately, and in
a lot of cases, recycled for re-use or re-processed into alternative
products.
Always ask to see the waste carriers licence if you use a company to dispose
of any waste for you. This licence is issued by the Environment Agency. The
company should give you a copy of the waste consignment note that travels with
the waste on to its final destination at the disposal site. If you knowingly
use an un-registered company to dispose of your waste, and it ends up being fly
tipped, you may face prosecution.
- Will you remove something that has been dumped on the pavement?
Yes, the council can arrange for the removal of waste, as long as the
item(s) have been dumped on a public highway or Council-owned land.
