    The Town and Country Planning (Fees for Applications and Deemed Applications) (Amendment) (England) Regulations 2010

    On 26 February 2010, fees for amendments to planning applications came into effect:

    Application for non-material changes to planning permissions:

    Householder: £25

    All other cases: £170

    Application for a replacement planning permission subject to a new time limit (extension of time):

    Householder application: £50

    Major development: £500

    All other cases: £170 

    Increase in VAT for developer contribution fees from 1 January 2010 

    With effect from 1 January 2010, VAT payable on the administration fee for developer contributions has returned to 17.5% in line with the standard rate.

    South Downs National Park confirmed

    Hilary Benn, Secretary of State for Environment, Food and Rural Affairs announced on 12 November 2009 the creation of a new National Park for the South Downs.

    The South Downs National Park will come into being on 31 March 2010. The map shows the area that comprises the National Park. A more detailed map can be found on Natural England’s website. A National Park authority will also be established.


    Additional application forms

    On 1 October 2009, two new application forms were introduced.

    • non-material amendments to planning permissions.
    • applications to extend the life of  planning permissions and any associated conservation area or listed building consent  

    Both forms are available in paper form only but it is intended that they will become integrated into the Planning Portal online application service in April 2010.

    Public Open Space and Transport contribution

    An annual inflationary increase in contribution costs takes immediate effect and a copy of the pricing schedule is included on this page

    South Downs National Park confirmation

    On 31st March 2009 Hilary Benn, Secretary of State for Environment, Food and Rural Affairs announced that a new National Park will be created for the South Downs.

    The two statutory purposes of the National Parks' designation are:

    • to conserve and enhance the natural, wildlife and cultural heritage of the areas; and
    • to promote opportunities for the public understanding and enjoyment of the special qualities of their areas

    If there is a conflict between the two, conservation takes precedence.

    An interim National Park Authority will be established in April 2010 and will come into being in April 2011.

    Charges for developer contributions, pre-application advice, documents and services

    Our fees for developer contributions, pre-application and other advice, services and documents are increasing on 1 April 2009.

    Environmental Improvements contribution

    From 1 April there will also be an additional developer contribution of £500 per dwelling for Environmental Improvements, which was agreed at Council in February.

    This additional contribution will be applied to all applications for new dwellings received from 1 April 2009 onwards.

    Fasttrack householder appeals system

    The Planning Inspectorate is introducing procedures to speed householder appeal procedures from 6 April 2009. Householder appeals must be submitted within twelve weeks of refusal or imposition of a condition, using an electronic submission system.

    Decisions will be made within 8 weeks. 

    Changes to general appeal procedures

    Procedures for other appeal types are also changing from 6 April 2009.

    One of those changes means that, rather than the appellant choosing the procedure, the Planning Inspectorate will decide whether an appeal is to be dealt with by an exchange of statements (written representations), at a Hearing or a Public Inquiry. 

    Speaking at planning committee

    We now have a scheme that allows people to address the Council’s Planning Committee on particular applications where they have submitted comments in writing within the publicised date and where that application is to be determined by the Planning Committee.
